WAIVER, RELEASE, AND INDEMNITY AGREEMENT
For consideration of permitting the signer of the form below to participate in activities at ROBERTS HALL, 831FLORIDA AVENUE, LYNN HAVEN, FLORIDA 32444, the undersigned hereby voluntarily releases, discharges waives and relinquishes any and all actions or causes of action for personal injury, property damage or wrongful death occurring to him or her, which injury, property damage or wrongful death arises as a result of engaging in, or receiving instructions in said reenacting activity and any activities incidental to such activities or instructions, wherever, whenever or however such may occur. The undersigned does for him herself, his/her heirs, executors, administrators and assigns hereby, waive, discharge and relinquish any action or causes of action, which may hereafter arise for him/her and for his/her estate, and agree that under no circumstances will he/she or his/her heirs, executors, administrators and assigns prosecute or present any claim for personal injury, property damage or wrongful death against ROBERTS HALL, INDEPENDENT ORDER OF ODD FELLOWS (IOOF), or against any of its agents, trustees, members, servants, or employees for any of said causes of action, whether the same shall arise by negligence of any of said persons or organizations, or otherwise. IT IS INTENTION OF (participants name) BY SIGNING THIS DOCUMENT, TO EXEMPT AND RELIEVE THE ORGANIZATION(S), OFFICER(S) AND INSTRUCTOR(S) NAMED HEREIN AND THEIR AGENTS, TRUSTEES, MEMBERS, SERVANTS, OR EMPLOYEES, FROM LIABLITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE. BY SIGNING THIS DOCUMENT, THE SIGNOR ACKNOWLEDGES THAT HE/SHE ASSUMES THE RISK OF PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH UPON HIM/HERSELF FOR POSSIBLE EXPOSURE TO ANY PANDEMIC VIRUS, CORONA VIRUS 19, AND ANY RELATED PANDEMIC ILLNESS WHICH MAY OCCUR AT ROBERTS HALL.
The undersigned, for him/herself, his/her heirs, executors, administrators or assigns agrees that in the event any claim for personal injury, property damage or wrongful death shall be prosecuted against the organization or officer(s), he/she shall indemnify and hold them harmless from any and all claims or causes of action by whomever or wherever made or presented for personal injuries, property damage or wrongful death.
The undersigned acknowledges that he/she read the foregoing paragraphs and fully understands the legal rights that he/she is giving up by signing this document. He/she further warrants that he/she has been fully and completely advised of potential hazards and dangers, including the Pandemic Virus, Corona Virus 19, and any related Pandemic Illness, incidental to engaging in the activity at ROBERTS HALL, 831 FLORIDA AVENUE, LYNN HAVEN, Florida, 32444.
Roberts Hall Rental Contract
FOR ALL PATRONS OF ROBERTS HALL PLEASE HELP US MAINTAIN THE CLEANLINESS AND ORDER OF THIS HISTORIC COMMUNITY BUILDING.
The hall and grounds must be left neat and clean.
NO SMOKING in building or near doorways.
Alcohol may be served but not sold. User is responsible for behavior of participants and observance of local laws. (Open container law)
Roberts Hall walls may be used only by using the picture rails. Absolutely no holes in the walls or tape on the walls. Limited use of Blue Painter’s tape and Command hooks is okay and must be removed at end of event. Complete forfeit of deposit may result if there is damage to walls.
Anything taken down or moved for the event must be returned to its original position. Take pictures.
Use of stage lights and sound system are prohibited without payment and prior consent.
User is responsible for providing set-up and removal of user-owned or rented equipment after each use.
If use of the hall involves children, adequate supervision is required.
No food may be left out or stored in the refrigerator after the event.
All tables and counters must be wiped clean. Floor must be swept of debris and spills mopped.
The kitchens’ appliances may be used for the event. The kitchens must be left clean.
PARKING: Please do not park in front of Grocery Outlet; that space is for their customers. There is city-owned property between the clinic and 8″ street, as well as surrounding on-street parking. Please be respectful of surrounding homes and businesses. Do not park in the Doctor’s parking lot at 825 Florida Avenue during the week.
DO NOT STAND ON ANY FURNITURE IN THE HALL. DO NOT ALLOW CHILDREN OR ANYONE ELSE TO CLIMB ON FURNITURE. USE LADDERS! Downstairs, you’ll find ladders in storage room. Upstairs the ladders are behind the stage curtain and or in table closet.
Lights and Sound System available upstairs for $50 each or $80 for both.
A key for use during the agreed upon time is required for a $50 deposit, returned to you upon return of key. Keys are not to be duplicated, loaned, or used outside of your allotted time unless by consent of the Rental Coordinator prior to usage.
A deposit of $250 is required at the time of reservation. $50 is nonrefundable. The remainder of the deposit will be returned following the event. Any infractions of the rules may result in fines. In addition, any cleaning fees or damages will be deducted from the deposit. The deposit is waived for IOOF members; however, they are still bound by the conditions and policies set forth.

I have read and agree to abide by the rules and policies set forth in the Roberts Hall rental contract. I agree to hold free from responsibility the Independent Order of Odd Fellows, or any of its members, for any loss or damage to person or personal property. I agree to be financially responsible for any damage incurred to facility, grounds, or equipment during the period of use and be wholly responsible for the supervision and control of all persons and activities during such use. A member of management may be present during event. If using PayPal, I agree to pay fees incurred to the hall, deducted from deposit, or added to total room rental when applicable.
